Federal law gives all immigration officers “power without warrant” to “arrest any alien in the United States, if he has reason to believe that the alien” is violating any immigration law and is “likely to escape before a warrant can be obtained for his arrest.” In practice, ICE typically obtains administrative warrants to effectuate arrests. These are issued by the Attorney General and give ICE the authority to arrest a specific person in any public location but not in the privacy of a home. Nonetheless, certain politicians and judges have demanded that ICE obtain a judicial warrant to make any arrest, which has no basis in the law.
