Federal law requires that anyone who is eligible for a free public education is also eligible for the national school lunch and school breakfast programs. In 1982, the Supreme Court ruled (5-4) in Plyler v. Doe that states cannot deny children a free public education based upon their immigration status. Hence, all illegal immigrants are eligible for the national school lunch and school breakfast programs.
