Under federal law, it is illegal and punishable by up to ten years in prison for an illegal alien to receive, possess, or transport any firearm or ammunition. A 2004 federal audit of 200 background check denials found that 11% involved an illegal alien attempting to purchase a firearm. None of these cases resulted in a criminal investigation.
