Prosecutions of Former Presidents
CNN’s former chief legal analyst, Jeffrey Toobin, claims that “conservatives on the Supreme Court” ignored the “text of the Constitution” by “preventing virtually all criminal prosecutions of former presidents for crimes committed while in office.”
IN FACT, their ruling prevents presidents from prosecuting their predecessors for “official actions” within their “conclusive and preclusive constitutional authority,” and the ruling explicitly states that there is “no immunity for unofficial acts.”
Without this ruling, Trump could prosecute Biden for attempting to illegally transfer student loans from borrowers to taxpayers. Trump could also prosecute Obama for attempting to illegally make 4-to-5 million illegal immigrants immune from deportation and eligible for Social Security and Medicare.
Until the Biden administration prosecuted Trump, such matters were always settled by lawsuits, not criminal prosecutions.
