Federal Voting Regulations

U.S. Senator Bernie Sanders (I–VT) claims that the Constitution forbids Congress from enacting President Trump’s plan to create national standards to ensure that states conduct elections “honestly.”

IN FACT, the Constitution gives Congress the power to “make or alter” state “regulations” for federal elections. Moreover, Sanders and 99.6% of Congressional Democrats voted for the “For the People Act of 2021,” an 800-page bill of voting regulations which declares that:

the Constitution of the United States grants explicit and broad authority to protect the right to vote, to regulate elections for Federal office, to prevent and remedy discrimination in voting, and to defend the Nation’s democratic process.

Among hundreds of provisions, the Democrat bill would have required that all states:

  • establish and operate” an “automatic” voter “registration system.”
  • never require “more than” the “last 4 digits” of a “Social Security number” in order to register to vote.
  • never “require an individual to provide any form of identification as a condition of obtaining an absentee ballot.”
  • allow people to vote without identification if they sign a “sworn written statement” that attests the “individual is eligible to vote in the election.”
  • allow convicted felons to vote after they leave prison.
