Birthright Citizenship
U.S. Congresswoman Jasmine Crockett (D–TX) claims that President Trump’s “attack on birthright citizenship” is “unconstitutional and un-American” because the Constitution states, “If you’re born on U.S. soil, you are a U.S. citizen.”
IN FACT, the Constitution states that people born on U.S. soil are citizens only if they are “subject to the jurisdiction of the United States.” U.S. Senator Jacob Howard, who crafted this language, introduced it in the Senate by stating that such “jurisdiction” does NOT include the children of “foreigners, aliens,” “ambassadors,” “an Indian belonging to a tribe,” and anyone not subject to the “same jurisdiction in extent and quality as applies to every citizen of the United States now.”
