New York Attorney General Letitia James claims “the 14th amendment is clear that any child born in this country is a citizen.”

IN FACT, the 14th Amendment states that such children are “citizens” only if they are “subject to the jurisdiction of the United States.” The U.S. senator who created the 14th stated that such “jurisdiction” does NOT include the children of “foreigners, aliens,” “ambassadors,” “an Indian belonging to a tribe,” and anyone not subject to the “same jurisdiction in extent and quality as applies to every citizen of the United States now.”
